A - Introduction

These conditions of sale (hereinafter only "General Conditions") govern the sale of products marketed by www.dadolo.com . The Customer can communicate with Tuttoverde Snc by: e-mail at: servizioclienti@dadolo.com or by calling (+39) 0544455445 at the normal rate or by mail by writing to the address: Tuttoverde Snc Via A. Fortis 2 48123 Ravenna.

All contracts for the purchase of products concluded, through the website www.dadolo.com and according to the procedures indicated therein, between the seller and the Customer, will be governed by these General Conditions.

All published prices are inclusive of VAT.

B - Acceptance of the conditions of sale

  • 1. The contract stipulated between Tuttoverde Snc and the Customer must be considered concluded with the acceptance, even if only partial, of the order by Tuttoverde Snc , which reserves the right, at its sole discretion, to accept the order. Acceptance is considered tacit, unless otherwise communicated in any way to the Customer. By placing an order in the various ways provided, the Customer declares to have read all the information provided during the purchase procedure and to fully accept the general and payment conditions transcribed below.

  • 2. If the Customer is a final consumer (i.e. a natural person who purchases the goods for purposes not related to his professional activity), once the online purchase procedure has been completed, he will print or save an electronic copy and, in any case, keep these general conditions of sale, in compliance with the provisions of articles 3 and 4 of Legislative Decree n. 185/1999 on distance selling.

  • 3. Any right of the Customer to compensation for damages or indemnity is excluded, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and/or things, caused by the non-acceptance, even partial, of an order.

C - Method of purchase

  • 1. The Customer can only purchase the products present in the Tuttoverde Snc electronic catalog at the time the order is forwarded and which can be viewed at www.dadolo.com , as described in the relative information sheets. The technical information entered on the www.dadolo.com site faithfully reproduces that of the manufacturers of the goods included in the catalogue. Tuttoverde Snc , therefore, reserves the right to modify the technical information of the products to adapt them to those provided by the producers, without the need for any prior notice. It is understood that the image accompanying the description of a product may not be perfectly representative of its characteristics, and may differ in colour, size, accessory products present in the figure. All purchasing support information (Glossary, Purchasing Guide, etc...) is to be understood as simple generic information material, not referable to the real characteristics of each individual product.

  • 2. Correct receipt of the order is confirmed by Tuttoverde Snc by means of an e-mail reply, sent to the e-mail address supplied by the Customer. This confirmation message will contain the date and time of receipt of the order and an Order Number , to be used in any further communication with Tuttoverde Snc . The message re-proposes all the data entered by the Customer who undertakes to verify its correctness and to promptly communicate any corrections, according to the methods described in this document. The Customer can also check the status of his order by accessing the web area dedicated to him and viewing the order status.

  • 3. In the event of non-acceptance of the order, Tuttoverde Snc undertakes to timely notify the Customer.

  • 4. The Customer can request the cancellation of the order up to the moment in which the same is not yet in preparation in the warehouse. The order status is clearly visible in the "Status" section of your Personal Area. The order can no longer be canceled if the indication "Complete" appears. In this case, the right of withdrawal may be applied as indicated in the relative section

  • 5. All prices on the site are to be understood as prices to the public and, therefore, inclusive of VAT. Tuttoverde Snc reserves the right to change prices at any time, without notice. In the event that an incorrect and/or clearly derisory price is published, for whatever reason (error in our systems, human error, etc.), the order will be cancelled, even in the case of initial validation.

  • 6. The quantities of product available at the time of the order are not visible on the www.dadolo.com website. Since the simultaneous access of multiple users-customers and the simultaneous possibility of "online" orders modify the availability of the product, Tuttoverde Snc does not guarantee the certainty of assignment of the ordered goods.

  • 7. On certain products, subject to price promotions, Tuttoverde Snc reserves the right to accept orders by reducing the quantities, subject to communication and acceptance by the Customer, failing which the order will be considered cancelled.

D - Methods of payment

  • 1. Transaction security
    Online transactions, on the Dadolo.com website, by credit card are made on the website of our credit card payment manager: PayPal. Credit card details and all data are entered via a PayPal Secure Server which adopts the SSL (Secure Socket Layer) protection system. This certified protocol allows you to communicate in a way designed to avoid the interception, modification or falsification of information. Dadolo.com is not aware of the credit card data used by its customers.

  • 2. Advance Bank Transfer
    In case of payment by bank transfer in advance, the shipment of the order takes place only when the actual crediting to the c / c of Tuttoverde Snc , which must take place within 5 working days from the date of acceptance of the order, after which the order is considered automatically cancelled.

    The purpose of the bank transfer must include the order number which is issued in the order confirmation email.

    The bank details on which to make the transfers are shown in the order confirmation e-mail.

  • 3. Credit Card and Prepaid Credit Card
    Credit cards and prepaid credit cards are treated equally by our systems. In case of purchase through the Credit Card payment method, the transaction will be processed by the international company PayPal.

    Under no circumstances will Tuttoverde Snc have access to the data of the credit cards used.

    In cases of purchase of goods with Credit Card payment method, together with the conclusion of the online transaction, the amount relating to the goods delivered will be charged to the Customer's credit card. The credit cards accepted are all those that rely on the Visa, Mastercard and America Express circuits.

    In the event of cancellation of the order, both by the Customer and in the case of non-acceptance by Tuttoverde Snc , the same will simultaneously carry out the crediting and cancellation of the transaction and the release of the committed amount. The release times, for some types of cards, do not depend on us. Requested the cancellation of the transaction, in no case Tuttoverde Snc can be held responsible for any damages, direct or indirect, caused by delay in the failure to release the amount committed by the banking system.

    Tuttoverde Snc reserves the right to ask the customer for additional information (eg landline number) or to send copies of documents proving ownership of the card used. In the absence of the required documentation, Tuttoverde Snc reserves the right not to accept the order.

    At no time during the purchase procedure is Tuttoverde Snc able to know the information relating to the buyer's credit card, as they are entered directly on the PayPal site which manages the transaction (with very high security systems); since there is no data transmission, there is no possibility that this data will be intercepted. No Tuttoverde Snc computer archive contains or stores such data. Under no circumstances Tuttoverde Snc can therefore be held responsible for any fraudulent or illegal use of credit cards by third parties, upon payment for products purchased on www.dadolo.com .

  • 4. PayPal
    In case of purchase through the PayPal payment method, at the conclusion of the order the Customer is directed to the PayPal login page.

    The amount relating to the order is charged to the PayPal account at the time of order acquisition.

    In case of cancellation of the order, either by the customer or in case of non-acceptance by Tuttoverde Snc , the amount will be refunded to the customer's PayPal account.

    The cancellation of the order is possible up to the moment in which the same is not yet in preparation in the warehouse.

    Requested the cancellation of the transaction, in no case Tuttoverde Snc can be held responsible for any damages, direct or indirect, caused by delay in the failure to release the amount committed by PayPal. At no time during the purchase procedure is Tuttoverde Snc able to know the customer's financial information. Since there is no data transmission, there is no possibility that this data will be intercepted. No Tuttoverde Snc computer archive contains or stores such data. For each transaction made with the PayPal account, the Customer will receive a confirmation email from PayPal.

E - Method of delivery

Tuttoverde Snc carries out orders with delivery in the following states.
Austria, Belgium, Crete, Denmark, Estonia, Finland, France, Germany, Greece, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Portugal, United Kingdom, Slovenia, Spain, Sweden, Switzerland.
Shipping to other states will be evaluated from time to time after a quote. Customs costs, where foreseen, are always to be considered at the expense of the customer.

Tuttoverde Snc does not ship to Mail Boxes, post offices, PO boxes and to companies that provide domiciliation services. For each order placed on www.dadolo.com , Tuttoverde Snc issues a sales note (equal to a receipt) or an invoice for the material shipped. For the issuance of the tax document, the information provided by the Customer at the time of the order is valid. After the document has been issued, no changes will be possible.

The delivery of the ordered goods means on board the truck. There are no floor delivery, porterage or installation services.

Shipping costs are charged to the customer and are explicitly highlighted at the time the order is placed.

The goods travel with packaging made directly by the manufacturer or in customized boxes by Tuttoverde Snc

The delivery times of the goods ordered are purely indicative and are published in the appropriate table under the heading "indicative delivery times"; the same may undergo variations due to force majeure or due to traffic conditions and road conditions in general or by act of the Authority. Standard delivery will take place at the following times: from 9.00 to 13.00; from 14.00 to 18.00, every day, except holidays, from Monday to Friday.

No responsibility can be attributed to Tuttoverde Snc in the event of a delay in the order or in the delivery of the goods ordered.

Upon delivery of the goods by the courier, the Customer is obliged to check:

  • that the number of packages delivered corresponds to what is indicated in the delivery document

  • that the packaging is intact, not damaged, wet or otherwise altered;

  • that sealing materials other than adhesive tape bearing the logos of the websites managed by Tuttoverde Snc have not been used

Obvious external damage or mismatch of packages.
Any external damage or the mismatch in the number of packages must be immediately reported to the courier who carries out the delivery, adding the words "withdrawal with reserve for damaged package", or "withdrawal with reserve for open package" or "withdrawal with reserve for missing packages".

It is also required to open an anomaly file with Tuttoverde Snc , by sending the following email info.

The opening of this file must be carried out no later than 8 days from receipt of the goods.

Once the courier's document has been signed, the Customer will not be able to make any objection regarding the external characteristics of what has been delivered.

Packing intact
Even in the presence of intact packaging, the goods must be collected subject to inspection by adding the wording "I ACCEPT SUBJECT TO INSPECTION BECAUSE IT IS NOT POSSIBLE TO VERIFY THE INTERNAL CONTENT OF THE PACKAGES" and verified within 8 calendar days of receipt. Any hidden damage or anomalies must be reported in writing by e-mail to the mail: expeditions@dadolo.com

Any notification beyond the aforementioned terms will not be taken into consideration. For each declaration, the Customer assumes full responsibility for what is declared.

If the customer does not accept the goods by signing subject to control, additional costs may be required for sending the replacement pieces.

At the time of shipment, our systems will send a shipment confirmation email with any product traceability code. The courier will in turn send an email confirming acceptance of the shipment indicating that the shipment has been accepted and indicating a traceability code.

  • 1. Delivery by express courier
    Standard delivery will take place at the following times: from 9.00 to 13.00; from 14.00 to 18.00, every day, except holidays, from Monday to Friday.

    The courier makes the first delivery without notice. In case of absence of the Customer, the courier leaves a notice and tries the delivery again in the next 24 hours; in case of further absence, notice is left again and the shipment is placed in storage. The Customer will be contacted by the Tuttoverde Snc Care Team with which he will define the delivery details. In the event of storage, storage costs may be charged to the Customer.

  • 2. Location and places of delivery
    For some locations such as islands, mountain resorts, limited traffic areas, difficult to reach or peripheral areas, military areas, ports and airports or other disadvantaged locations, surcharges are possible for particular delivery conditions. For this reason, Tuttoverde Snc reserves the right to request, with a prior estimate, an additional sum as a surcharge on the standard delivery. The customer will be able to accept the additional costs of transport for these mail locations.

    Tuttoverde Snc reserves the right, in the event that the locality is not served in any way by the carriers used normally, to cancel the order upon notification, and to proceed with the total refund of the order. Payment for the goods by the customer will be made using the method chosen when placing the order. No further expense or commission is due to Tuttoverde Snc .

  • 3. Telephone Alert
    In the case of telephone notification, the courier will contact the customer before making the delivery. During the telephone contact, the Customer can ask the courier to fix a delivery, no later than 72 hours, and the relative time slot (morning or afternoon).

    The telephone notification request is sent directly to the courier. Tuttoverde Snc assumes no responsibility for any disservices related to the telephone notification as it is not directly provided by us.

    Delivery will take place at the following times: from 9.00 to 13.00; from 14.00 to 18.00, every day, except holidays, from Monday to Friday.

    Tuttoverde Snc is in no way responsible for failure to provide the requested service.

    For this type of delivery, an additional contribution of 4 Euros is applied to the cost of delivery by express courier, clearly highlighted when choosing the shipping method.

F - Processing and delivery times

  • 1. Order fulfillment times
    "Order fulfillment times" means the time interval between the receipt of the order and the delivery of the product to the courier.

    All orders, containing products available in stock, for which payment confirmation has been received by 12.00 on a working day, are entrusted to the courier already in the evening of the same day except in cases of force majeure (strike of couriers or shipping personnel and in general force majeure)

  • 2. Express courier delivery times
    The table below shows the indicative delivery times expressed in hours, in cases of delivery by express courier, from the moment the courier takes charge of the shipment (collection of the shipment at our Logistics Center by the courier).

    The other types of delivery such as those that require telephone contact with the courier to define the time of delivery of the service may be delayed. The Customer will be contacted by the courier to define the delivery details.

    Italy Sicily, Calabria, Sardinia 2-3 days.

    Delivery times for countries other than Italy
    Austria, Belgium, Denmark, Estonia, Finland, France, Germany, Ireland, Latvia, Lithuania, Luxembourg, Netherlands, Portugal, United Kingdom, Slovenia, Spain, Sweden, Switzerland from 2 to 5 days. by express courier

    Times are purely indicative and may vary according to the country of delivery and the type of material to be delivered.

G - Delivery costs

  • 1. Delivery costs by express courier
    The cost of delivery is calculated automatically according to the value of the products purchased.

    For purchases over €100, no shipping costs will be requested, with the exception of ancillary services requested by the customer (e.g. Telephone Notice).

    Any ancillary costs for non-standard services are highlighted at the time of the order.

    The costs indicated are valid for all the countries listed.

H - Right of withdrawal

  • 1. In compliance with the provisions of the Consumer Code, as amended by Legislative Decree no. 21/2014, the Customer who plays the role of consumer and, therefore, the natural person who acts for purposes unrelated to the professional activity, has the right to withdraw from the purchase contract, without giving any reason and without having to incur costs other than those specified in paragraph n. 3, no later than 14 days from delivery, or from the day on which the Customer or a third party designated by the latter acquires physical possession of the goods purchased or of the last batch of goods purchased. The conditions and procedure for exercising this right will be specified in the following paragraphs.

  • 2. The Customer who intends to exercise the right of withdrawal referred to in the previous paragraph must send an email to recesso@dadolo.com indicating the order number for which one or more products are to be returned and indicating the bank details to make the refund if the order was paid by bank transfer. The Tuttoverde Snc Customer Service will take charge of the request.

    Upon receipt of the declaration of withdrawal, Tuttoverde Snc will send the customer an email confirming receipt.

    The Customer must arrange for the shipment, carefully packed in the manufacturer's original packaging, within 14 days via its own trusted courier. The shipping costs for returning the goods to Tuttoverde Snc will be charged to the customer.

  • 3. The shipment of the goods to be returned must take place no later than 14 days from the date on which the Customer communicated to Tuttoverde Snc the decision to withdraw from the purchase contract.

    Tuttoverde Snc , in compliance with the provisions of art. 56 of Legislative Decree no. 21/2014, once compliance with the conditions referred to in paragraph 4 has been verified, will refund the cost of the product to the Customer within 14 days of receiving the notice of withdrawal, without prejudice to the right to withhold the refund until the date of return of the product to its warehouses or until the date on which the Customer sends proof of effective shipment and delivery of the goods to the courier. Tuttoverde Snc is not required to reimburse additional costs if the Customer has chosen a type of delivery other than the least expensive type of delivery offered ("basic" shipping).

    The refund will be made in the same way used by the Customer for the purchase or, if specifically requested, by bank transfer, credit card reversal, PayPal refund or postal order (in this case, the costs will be charged to the Customer).

  • 4. The right of withdrawal is subject to the following mandatory conditions:

    • the Customer can exercise the right of withdrawal only and exclusively with regard to the entire product; it will not be possible to exercise withdrawal only on a part of the product purchased (for example accessories, attached software, etc ...).

    • The right of return does not apply to products:
      - audiovisuals, software and consumables;
      - products specifically or personally created for the consumer;
      - for perishable or rapidly changing goods;
      - for the purchase of newspapers or magazines;
      - for services which, before the expiry of the deadline for exercising the withdrawal, have already been performed with the consent of the consumer.

    • the purchased product must be returned in its original packaging, complete with all accessories and its documentation;

    • the product must be returned in perfect condition, products that show signs of damage, wear or dirt will not be accepted;

    • the returned product must bear the same serial number present on the invoice, otherwise, if the serial number is different, the withdrawal will not be accepted and the product will be made available to the Customer again, without any financial reimbursement by Tuttoverde Snc towards him;

    • The shipment for the return of the product is under the responsibility of the Customer, until the moment in which Tuttoverde Snc confirms that it has received the product.

  • 5. The right of withdrawal is lost if the Customer does not return the goods to Tuttoverde Snc within 14 days from the date on which he communicated the withdrawal. The term is considered respected if the Customer sends the goods before the expiry of the 14 days.

    The right of withdrawal also lapses in the event of a substantial defect in the returned product (lack of internal packaging and/or documentation and/or original packaging from the manufacturer; absence of integral elements and accessories of the product; damage; unsuitable state of return) and in general in the event of failure to comply with the conditions referred to in paragraph n. 4.

    In all cases of forfeiture of the right of withdrawal, Tuttoverde Snc will return the goods to the Customer who will not be entitled to any refund.

I - Renunciation of the purchase

We inform you that it is the Customer's right to reject the goods upon delivery. However, please note that, upon issue of the refund credit note, in the event of advance payment (credit card, Paypal, bank transfer), the shipping costs will be reversed up to the delivery address and returned to the sender. Therefore, only the amount of the product will be refunded, net of return transport costs.

J - Guarantees

  • 1. Legal guarantee
    All products marketed by Tuttoverde Snc are covered by a 24-month legal guarantee for lack of conformity, pursuant to art. 129) of Legislative Decree no. 206/2005 (Consumer Code).

    Under the legal guarantee, Tuttoverde Snc Srl is liable towards the Customer-Consumer (natural person who acts for purposes unrelated to business, industrial, commercial, artisanal or professional activities carried out), for any lack of conformity existing at the time of delivery of the product, as required by art. 130 of Legislative Decree no. 206/2005 and within 24 months from the date of purchase.

    The lack of conformity exists when the product is not suitable for the use for which it is intended, does not conform to the description or does not possess the qualities and/or performance promised by the seller and typical of the product sold, or the specific qualities and performance required by the Customer-Consumer when this has been the subject of a specific agreement between the parties.

    The declaration of the lack of conformity (art. 132, 1st paragraph), which occurs within the term of validity of the legal guarantee (24 months), must be made, under penalty of forfeiture, within two months from the date of discovery (art. 132, 2nd paragraph). In the event of a lack of conformity, the Customer-Consumer has the right to ask the seller, at his choice and free of charge, to repair or replace the goods, unless the remedy requested is objectively impossible or excessively onerous (Article 130, paragraphs 3 and 4). The repairs must be carried out within a reasonable period, after which the Customer-Consumer will have the rights pursuant to art. 130, paragraph 7); the seller, after reporting the lack of conformity, will be able to offer the Customer-Consumer the remedies referred to in paragraph 9) of the art. 130, with the effects referred to in lett. a and b) of the same provision.

    To use the assistance, the Customer-Consumer must keep the invoice or receipt certifying the executed order that he will receive together with the purchased goods.

    If, following an intervention by an Authorized Service Centre, there is no lack of conformity pursuant to Legislative Decree no. 206/2005 (Consumer Code), the Customer-Consumer will be charged for any costs of verification and recovery required by the Authorized Assistance, as well as transport costs if incurred by Tuttoverde Snc .

  • 2. Commercial or conventional guarantee

    • 2.1 in addition to the legal guarantee for lack of conformity, the products marketed by Tuttoverde Snc enjoy the commercial or conventional guarantee of the manufacturer.

    • 2.2 The manufacturer's commercial or conventional guarantee is additional and not onerous for the Customer-Consumer and is supplied, at the choice of the Customer-Consumer, according to the methods illustrated in the documentation inside the product packaging and present on the website www.dadolo.com in the appropriate area and will be provided by assistance centers authorized by the manufacturer. If, following intervention by an Authorized Assistance Center, the defect is not covered by the commercial or conventional guarantee of the manufacturer, the Customer-Consumer will be charged for any costs of verification and recovery required by the Authorized Assistance, as well as transport costs, if supported by Tuttoverde Snc .

    • 2.3 Replacements in the event of DOA (Dead On Arrival: product not working when first switched on), without prejudice to the existence of the conditions for the application of Legislative Decree no. 206/2005 (Consumer Code), will be carried out only if expressly provided for by the manufacturer. The times for replacement or repair of the product, provided they are reasonable, depend exclusively on the manufacturer. Tuttoverde Snc ensures that the repair/replacement times are reasonable.

    • 2.4 No damage can be requested from Tuttoverde Snc for any delays in carrying out repairs or replacements of products under commercial or conventional warranty, except in cases of willful misconduct or gross negligence.

    • 2.5 In cases where the application of the guarantees provides for the return of the product, the goods must be returned by the Customer-Consumer in the original packaging, complete in all its parts (including the manufacturer's packaging and any documentation and accessory equipment: manuals, cables, etc...); to limit damage to the original packaging, it is recommended, when possible, to place it in a second box; the affixing of labels or adhesive tapes directly on the original packaging of the product should be avoided in all cases.

K - Privacy

The personal data requested during the order forwarding phase are collected by Tuttoverde Snc and processed on IT supports, in order to satisfy the obligations arising from the contract concluded with the Customer and will in no case or for any reason be transferred to third parties. Tuttoverde Snc guarantees its customers compliance with the legislation on the processing of personal data, governed by the privacy code pursuant to Legislative Decree No. 196 of 06.30.03. The data controller is Tuttoverde Snc , via A. Fortis 2, 48123 Ravenna, in the person who from time to time has the legal representation, unless a manager is appointed pursuant to art. 29 of Legislative Decree no. 196/2003.

The customer, at any time, has the right to revoke consent to the processing of personal data with written communication to be sent to the registered office of Tuttoverde Snc Srl. The customer, who declares to have received the information pursuant to art. 13 and on the rights due to the same, pursuant to art. 7 of Legislative Decree no. 196/2003, has the right to access their data in the manner provided therein. Marketing communications will be sent only with the explicit consent of the Customer issued together with the authorization to process and send it in the online registration form.

M - Jurisdiction and Applicable Law

The sales contract between the customer and Tuttoverde Snc is concluded in Italy and governed by Italian law. For the solution of civil and criminal disputes deriving from the conclusion of this distance selling contract, if the Customer is a consumer, the territorial jurisdiction is that of the reference court of his municipality of residence; in all other cases, the territorial jurisdiction is exclusively that of the Court of Ravenna.
